A. Introduction
Welcome to Newsahoot ("Company", "We", "Our", "Us"). These Terms and Conditions ("Terms") constitute a legally binding agreement between Newsahoot Media Private Limited (CIN: U85500RJ2023PTC086327), having its registered office at 111/22, Vijay Path, Mansarovar, Jaipur, Rajasthan - 302020, and the user ("User", "you", "your").
By accessing our website (https://newsahoot.com), our mobile applications, or enrolling in our "Critical Thinking with Current Affairs" live classes, you agree to be bound by these Terms.
B. Eligibility and Parental Consent
The Digital Personal Data Protection Act, 2023 (DPDP Act) mandates specific protections for "Data Principals" under the age of 18.
Minors: If you are under 18 years of age, you may use our Services only with the involvement and consent of a parent or legal guardian.
Parental Authority: By registering an account, purchasing a class, or allowing a minor to use our comment system, you represent and warrant that you are the legal guardian of said minor and you expressly consent to the processing of the minor’s personal data for educational purposes.
C. Live Classes (B2C)
The following specific terms apply to our Live Classes and direct-to-consumer offerings:
Personal Use Only: All materials, including presentation decks, worksheets, and recordings, are licensed for personal, non-commercial use only. You are strictly prohibited from copying, sharing, distributing, or reselling these materials without our written permission.
Attendance & Make-up Policy: We offer a maximum of twelve (12) make-up classes per subscription cycle for unavoidable absences. No additional make-up sessions will be provided beyond this limit.
Class Updates: By registering, you explicitly consent to receive class updates, schedules, and administrative messages via WhatsApp and email.
Dress Code & Environment: To ensure a safe learning environment, all students must remain fully clothed and in an appropriate setting during live sessions. Non-compliance is a violation of our safety standards and may lead to immediate termination of the plan without a refund.
Code of Conduct: We maintain a zero-tolerance policy for disruption. Respectful behavior towards instructors and peers is mandatory. Disruptive behavior may result in removal from the class without a refund.
D. Interactive Features
Parental Consent for Comments: Our platform includes a comment system to foster discussion. In compliance with the DPDP Act, verified parental consent is required for any minor to post comments.
Moderation: We reserve the right to review, edit, or delete any comment that we deem inappropriate, offensive, or unsafe.
Liability: While we moderate content, Newsahoot is an intermediary and is not liable for views expressed by users in the comment sections.
E. School Partnerships (B2B)
If you are a School or Educational Institution accessing our services under a separate Memorandum of Understanding (MOU):
Prevalence: In the event of a conflict between these Terms and your specific MOU, the terms of your signed MOU shall prevail.
License Grant: You are granted a non-exclusive, revocable license to use our "Critical Thinking with Current Affairs" curriculum solely for internal educational purposes within your institution.
Restrictions: You may not distribute our materials to public-facing websites or third parties.
F. Payments and Refunds
Live Classes (B2C): All fees must be paid in advance. No refunds or cancellations are permitted once registration is complete.
School Partners (B2B): Refund and payment terms for institutional partners are governed by the specific clause in your signed MOU.
G. Intellectual Property Rights
We retain all ownership, title, and intellectual property rights in its curriculum, presentation decks, worksheets, brand name, and website content. No transfer of ownership occurs through your use of the services. Unauthorized use of our IP may result in legal action.
H. Disclaimers and Limitation of Liability
Educational Purpose: We simplify complex news and current affairs to make them child-friendly. While we strive for accuracy, Newsahoot accepts no responsibility for decisions made by you or your child based on our content. Our content is for educational and informational purposes only.
Limitation: To the maximum extent permitted by law, We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
I. Data Protection and Privacy: We act as a Data Fiduciary under the DPDP Act.
Data Collection: We collect minimal data necessary to deliver the service (e.g., name, age, contact details, etc.).
Rights: As a parent/guardian, you have the right to access, correct, or erase your child’s data, and to withdraw consent for processing.
Grievance Redressal: For any data privacy concerns or to exercise your rights, please contact our Grievance Officer at the details provided in Section 11.
J. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
